Terms and Conditions (T&C)

1.Scope

These Terms and Conditions apply to all services provided by Weblancer.ch, including web design, WordPress/Elementor development, technical optimisation, consulting, training, support, graphic design and print-related work. Any deviations must be agreed in writing.

2. Offer and Contract Formation

A project is considered accepted once written confirmation has been sent to the client (email is sufficient). Offers are valid for 30 days unless stated otherwise.

3. Services

Weblancer.ch provides services according to current technical standards and with due professional care. Services include, but are not limited to:

  • Creation and customisation of WordPress websites (incl. Elementor)
  • Technical optimisation (performance, security, structure)
  • Hosting consulting (exclusively with Hostpoint.ch)
  • Backup services via ManageWP (if agreed)
  • Support, training and troubleshooting
  • Graphic design and print-ready layouts
  • Project-related consulting

4 Client Responsibilities

The client must provide all required content, data, logins and materials completely and in a timely manner. Delays caused by missing information or indecision may extend project timelines and result in additional costs.

5. Prices and Billing

Standard hourly rate: CHF 120.– Support may be offered as a monthly plan, as a fixed-fee arrangement or billed by the hour. External expenses such as hosting, plugins, themes, stock material or printing are billed separately or purchased directly by the client. Price changes will be communicated in advance.

6. Payment Terms

A 50 % advance payment of the agreed project amount is required before work begins. No project work starts without receipt of this payment. The remaining 50 % are due upon project completion or acceptance and must be paid within 20 days. Support work and smaller tasks are billed monthly or as agreed. Work may be suspended in case of late payment.

7. Rights and Usage

Upon full payment, the client receives the usage rights for the created work (designs, layouts, graphics, code), excluding any third-party material (plugins, themes, fonts, images). Open-source components such as WordPress and plugins are subject to their respective licences.

8. Content and Legal Compliance

The client is solely responsible for all content on their website, including copyright compliance, legal texts, data protection, trademarks and any legal obligations. Weblancer.ch does not provide legal review and accepts no liability for unlawful content or legal violations.

9. Liability

Weblancer.ch is liable only for damages caused intentionally or by gross negligence. No liability is assumed for:

  • hosting failures, outages or data loss
  • security vulnerabilities or malfunctions of third-party plugins, themes or WordPress
  • SEO changes or ranking losses
  • data loss if no backup service has been agreed
  • consequential loss, lost revenue or business interruption

Restorations, bug fixes or recovery after updates are billed at the standard hourly rate unless explicitly included in a support plan.

10. Acceptance

A project is considered accepted once the client provides written approval or actively uses the website in a production environment. Any changes requested after acceptance are considered new work.

11. Print Production

Print production may be handled through Weblancer.ch or directly via a printing provider. This is agreed on a project-by-project basis. No liability is assumed for printing errors caused by incorrect or incomplete materials supplied by the client.

12. Deadlines

Deadlines are approximate and non-binding. Delays caused by missing information, third-party providers, technical issues or client-side changes do not entitle the client to discounts or compensation.

13. Data Protection

Personal data is handled confidentially and used exclusively for processing the client’s project. The separate Privacy Policy of Weblancer.ch applies.

14. Cancellation and Project Termination

If the client terminates the project prematurely, all work completed up to that point is fully payable. Advance payments are non-refundable.

15. Severability Clause

If any provision of these Terms and Conditions is found to be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic intent of the original provision.

16. Jurisdiction and Applicable Law

Swiss law applies. The place of jurisdiction is Basel-Stadt (or Aarau if you prefer – sag einfach Bescheid und ich passe es an).
